Insurance Australia Group has confirmed it will pursue a public benefits application with the Australian Competition and Consumer Commission following the regulator’s Phase 2 determination that its proposed alliance with the Royal Automobile Club of Western Australia should not proceed on competition grounds.

The announcement represents a significant regulatory hurdle for IAG’s Western Australia expansion strategy. The ACCC’s Phase 2 finding is a material setback, as the merger control regime has identified sufficient competition concerns to reject the merger under standard competition law. Rather than accept the decision, IAG has chosen to seek relief through the public benefits phase, which allows the parties to argue that broader economic, customer, and community benefits outweigh the competition concerns the regulator identified.

This next phase evaluates factors beyond pure competition considerations. IAG will attempt to demonstrate that the alliance delivers net public benefit through improved technology platforms, claims management expertise, financial stability and global reinsurance protection. The company has committed to keeping RAC local and investing in enhancements to the member experience and insurance product offerings in Western Australia. The public benefits assessment is expected to take approximately 50 business days, providing clarity on the regulatory path within a clearly defined timeframe.

For investors, the implications are mixed. The ACCC’s Phase 2 determination indicates genuine competition concerns that could not be easily resolved. However, IAG’s decision to pursue the public benefits exemption suggests management believes a credible case exists for approval. The company operates over 18 billion dollars in annual insurance premiums across multiple brands in Australia and New Zealand, so the Western Australia opportunity represents a targeted expansion rather than a systemic business driver.

The RAC alliance is strategically important to IAG’s positioning in Western Australia, yet the regulatory path has proven more complex than initially anticipated. The company’s previous distribution agreements with RACV and RACQ in other states suggest a proven model for collaboration with motoring clubs, potentially supporting the public benefits argument.

The public benefits phase will require IAG to present a persuasive case that extends beyond commercial advantage to the parties. Demonstrating genuine benefits to RAC members, broader Western Australian consumers, and the community will be central to the application. The CEO’s emphasis on local investment and competitive products signals the company is positioning the alliance as beneficial to stakeholders beyond existing members.
